City Council <br /> Meeting Minutes <br /> June 1,2010 <br /> Page 8 of 10 <br /> 1. Barriers shall be placed on the mid block curb cut on Pine Street to prevent <br /> access to the building. Staff shall work with the applicant to determine the <br /> design of the barriers. <br /> 2. The applicant shall place dust free surfacing on the western parking area, and <br /> stripe for a minimum of eight parking spaces. <br /> 3. The outdoor patio shall not be used past 12 a.m. on any given day. <br /> 4. The SRU is granted to the applicant only and may not be exchanged at the <br /> time of sale. <br /> Planning Director Russ explained the property is currently accessed off Pine Street, <br /> Main Street, and the rear alley. Staff recommended the curb cut be removed, or barriers <br /> be placed so the area will not be accessed unless permitted by special review use. <br /> APPLICANT PRESENTATION <br /> Chad Sholders, 701 Main Street, Louisville, CO addressed Condition Number 1, and <br /> stated Staff's recommendation for barriers is premature. He felt the developer could <br /> work with the Staff to resolve all the issues at the same time. Planning Director Russ <br /> stated Staff is comfortable with delaying the discussion on the driveway access until the <br /> design for the east side of the building is brought forward. <br /> Mr. Sholders introduced his business partners, Terry Muller, Andrew Moeller, and Ken <br /> Golding. Andrew Moeller stated he is one of the owners and is very supportive of the <br /> concept. Ken Goldman stated he is very impressed with the City of Louisville and <br /> complimented the downtown business community. <br /> COUNCIL COMMENTS <br /> Councilor Muckle asked if Staff is comfortable with Council dropping Condition 1. <br /> Planning Director Russ confirmed Staff is comfortable dropping Condition Number 1. <br /> Mayor Sisk requested the Special Review Use be granted to the Main Street Drink and <br /> Dine, LLC only. <br /> MOTION: Councilor Muckle moved to approve Resolution No. 33, Series 2010, with the <br /> deletion of Condition No. 1 and making the SRU for the Main Street Drink and Dine, <br /> LLC only, seconded by Councilor Dalton. <br /> City Attorney Light stated a condition to the Special Review Use (SRU) is for the <br /> exclusive use of the owner /operator of Main Street Drink and Dine, LLC or affiliates <br /> only. Councilors Muckle and Dalton accepted the condition. <br /> VOTE: All were in favor. The motion carried. <br />
