City Council <br /> Meeting Minutes <br /> June 1, 2010 <br /> Page 9 of 10 <br /> RESOLUTION No. 34, SERIES 2010 A RESOLUTION APPROVING A FIRST <br /> AMENDMENT TO TRANSFER AND DEVELOPMENT AGREEMENT AND AN <br /> AMENDED AND RESTATED AGREEMENT, COVENANT AND RIGHT OF FIRST <br /> REFUSAL REGARDING 520 SOUTH BOULDER ROAD, LOUISVILLE, COLORADO <br /> Mayor requested a Staff presentation. <br /> Economic Development Director Star made the following introductions: Louisville <br /> Housing Authority Chairperson Steve Underhill and member Rob Kelly; three members <br /> of the Flatirons Habitat for Humanity: Executive Director John Lovell, President of the <br /> Board of Directors John Wood and Construction Manager Bob Wettergren. She <br /> explained the Flatirons Habitat for Humanity sent a letter to the City Council requesting <br /> reconsideration of the condition for the 14% of the affiliate's portion of the appreciation. <br /> Resolution No. 34, Series 2010 amends a 2003 agreement between the City and the <br /> Louisville Housing Authority (LHA), in order to allow a transfer of land on South Boulder <br /> Road to Flatirons Habitat for Humanity (FHFH). FHFH intends to build four or more <br /> affordable townhomes for sale. Resolution No. 34 also approves a three -way agreement <br /> between the City, LHA, and FHFH, outlining the terms, which the parties agree and <br /> expect development of the land. <br /> In 2003 the City transferred .58 aces to the LHA for the purpose of constructing and <br /> maintaining an affordable housing project. In the intervening seven years, LHA has not <br /> been able to accomplish this goal. However, in 2009, members of the LHA spoke with <br /> Flatirons Habitat for Humanity relative to their interest in fulfilling the goal. Resolution 34 <br /> approves documents to amend the 2003 actions to match the Habitat model for the <br /> provision of affordable housing. The Habitat will need some fee reductions and /or <br /> waivers from the City in order to build this project. The action removes the ability of the <br /> City to re- purchase this land. <br /> PUBLIC COMMENT <br /> Steve Underhill, Chair of the Louisville Housing Authority, explained the LHA has not <br /> been able to accomplish the goal of building an affordable housing project however the <br /> Flatiron Habitat for Humanity is interested in fulfilling this goal. He requested Council <br /> approval to amend the documents. <br /> John Lovell, Executive Director for Flatirons Habitat for Humanity, explained they are <br /> very anxious to begin this project in the community. To date, they have only built one <br /> home in Louisville, but are hoping, with their partnership with the University of Colorado, <br /> School of Architecture; they can build more homes on the lot. <br /> John Woods, President of the Board of Directors explained that ;and has been donated <br /> by municipalities and property owners to the Habitat for Humanity for construction of <br />
