RESOLUTION NO. 3 <br />SERIES 2016 <br />A RESOLUTION APPROVING A REZONING, FINAL PLAT AND FINAL PLANNED <br />UNIT DEVELOPMENT (PUD) TO CONSTRUCT A MULTI -USE DEVELOPMENT <br />CONSISTING OF 24 AGE RESTRICTED CONDOMINIUMS, 8 NON- RESTRICTED <br />CONDOMINIUMS, AND 38,000 SF COMMERCIAL/OFFICE. <br />WHEREAS, there has been submitted to the Louisville Planning Commission an <br />application approving a rezoning, final Plat and final Planned Unit Development (PUD) <br />to construct a multi -use development consisting of 24 age restricted condominiums, 8 <br />non - restricted condominiums, and 38,000 sf commercial /office; and <br />WHEREAS, the City Staff has reviewed the information submitted and found <br />that, subject to conditions, the application complies with the Louisville zoning and <br />subdivision regulations and other applicable sections of the Louisville Municipal Code; <br />and; <br />WHEREAS, after a duly noticed public hearing on December 10, 2015, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated December 10, 2015, the Planning <br />Commission recommends the PUD for the Foundry to City Council, with the following <br />conditions: <br />1. The 24 age restricted condominiums shall be for ages 55 and older. The 55 years <br />and older age restriction shall be placed on the deed of each age restricted unit <br />and shall also be included in the subdivision agreement, and a covenant <br />agreement enforceable by the City of Louisville. <br />2. Staff recommends the wall signs of the In -line building, shown as vertical address <br />numbers, be removed from the PUD and all wall signs must comply with Chapter <br />7 of the CDDSG and Chapter 17.24 of the LMC. <br />3. The applicant shall continue to work with the Parks Department on the type and <br />location of additional trees along Highway 42, prior to recordation. <br />4. The applicant shall continue to work with the Public Works Department on the <br />items listed in the October 25, 2015 memo. Each item shall be completed prior to <br />recordation. <br />5. Residential and Commercial Development shall be constructed concurrently. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado does hereby approve Resolution No. 9, Series 2016, a resolution <br />approving a rezoning, final Plat and final Planned Unit Development (PUD) to construct <br />a multi -use development consisting of 24 age restricted condominiums, 8 non - restricted <br />condominiums, and 38,000 sf commercial /office, with the following conditions: <br />Resolution No. 3, Series 2016 <br />Page 1 of 2 <br />
