negativeimpactsonthesurroundingareasandprotecttheenvironment,andspecifically <br />authorizeslocalgovernmentstocooperateandcontractwitheachotherforthepurposeof <br />planningandregulatingthedevelopmentoflandbymeansofa"comprehensivedevelopment <br />plan;"and <br />WHEREAS,inordertocontinue to ensurethattheuniqueandindividualcharactersof <br />LafayetteandLouisville,respectively,arepreserved,thePartiesbelievethatacomprehensive <br />developmentplanwhichrecognizestheannexedareasanddevelopmentapprovedbyeach <br />community,accompaniedbybindingcommitmentsbytheresponsiblejurisdictionsforthe <br />preservationoftheruralcharacterofsurroundinglandswithinthePlanArea,remainsinthebest <br />interestofthecitizensofeachoftheParties;and <br />WHEREAS,thelimitationofrezoningorotherdiscretionarylanduseapprovalsby <br />BoulderCountyandofannexationordevelopmentbyLafayetteorLouisville,ofcertainlands <br />withinthePlanArea,isintendedtoprecludeincreaseddevelopmentandurbansprawlwhich <br />wouldobliteratetheboundariesofLafayetteandLouisvilleandwould,ifpermittedinthe <br />unincorporatedarea,requiretheprovisionofurbanservicesbyBoulderCounty,in <br />contraventionofprovisionsoftheBoulderCountyComprehensivePlan;and <br />WHEREAS,thePartiesdesiretoplanforandregulatetheuseofthelandswithinthe <br />PlanAreathroughjointadoptionofamutuallybindingandenforceablecomprehensive <br />developmentplan;and <br />WHEREAS,thePartiesfindthatdesignatingaportionofthePlanAreatoremainrural <br />incharacterforthepurposeofpreservinga community buffer continues to servetheeconomic <br />andcivicinterestoftheircitizensandmeetsthegoalsoftheBoulderCountyComprehensive <br />Plan;and <br />WHEREAS,withrespecttotheannexationprovisionsherein,theCityofLafayetteand <br />theCityofLouisvilledeclarethatthe ruralpreservationdesignationsandlanduseregulations <br />containedinthisAgreementaffectthefuturedevelopmentofeachmunicipality.Consistent <br />withthemunicipalannexation,utilityservice,andlanduselawsoftheStateofColorado,this <br />Agreement,includingspecificallytheannexationandutilityserviceportionshereof,is <br />intendedtoencouragethenaturalandwell-orderedfuturedevelopmentofeachParty;to <br />promoteplannedandorderlygrowthintheaffectedareas;todistributefairlyandequitablythe <br />costsofgovernmentservicesamongthosepersonswhobenefittherefrom;toextend <br />government,servicesandfacilitiestotheaffectedareasinalogicalfashion;tosimplify <br />providingutilityservicestotheaffectedareas;tosimplifythegovernmentalstructureofthe <br />affectedareas;toreduceandavoid,wherepossible,frictionbetweentheParties;andto <br />promotetheeconomicviabilityoftheParties;and <br />2 <br /> <br />
