WHEREAS,thef:unctionsdescribedinthisAgreementarelawfullyauthorized toeachof <br />thePartieswhichperformsuch functionshereunder,asprovidedinarticle20oftitle29;part1of <br />article28oftitle30;part1ofarticle12oftitle31; andparts2and3ofarticle 23oftitle31; <br />C.R.S.,asamended;and <br />WHEREAS,§29-1-201,et seq.,C.R.S.,asamended,authorizesthePartiestocooperate <br />andcontractwithoneanotherwithrespecttofunctionslawfullyauthorizedtoeachofthe <br />PartiesandthepeopleoftheStateofColoradohaveencouragedsuchcooperationand <br />contractingthroughtheadoptionofColoradoConstitution,ArticleXIV,§18(2);and <br />WHEREAS,thePartieshaveeachheldhearingsafterproperpublicnoticeforthe <br />considerationofenteringintothisAgreementandtheadoptionofacomprehensivedevelopment <br />planforthesubjectlands,hereinafterreferredtoasthe "PlanArea",asshownonthemap <br />portionoftheDevelopmentRegulations("Regulations")attachedheretoasExhibitA. <br />NOWTHEREFORE,inconsiderationoftheaboveandthemutualcovenantsand <br />commitmentsmadeherein,thePartiesagreeasfollows: <br />1.LAFAYETTE/LOUISVILLEBUFFERAREACOMPREHENSIVEDEVELOPMENT <br />PLAN (2014 EXTENSION). <br />ThisAgreement,includingtheMapportionattachedheretoasExhibitA,isadoptedbythe <br />PartiesastheLafayette/LouisvilleBufferAreaComprehensiveDevelopmentPlan(2014 <br />Extension)(the"Plan")governingthePlanArea.This Agreement incorporates the entirety of the <br />Parties’ agreement, and supersedes and replaces the Original Agreementas amended by the First <br />and Second Amendments. <br />2.CONTROLLINGREGULATIONS. <br />RestrictionsonuseanddevelopmentoflandswithinthePlan Areaasprovidedinthe <br />Comprehensive Development Plan Regulations set forth in Section 3of the Agreement, below, <br />shallcontrolandsupersedelocalregulationsoftheRegulatoryPartytotheextenttheyconflict. <br />ForpurposesofthisPlan,the"RegulatoryParty"isthatPartyhavingregulatoryjurisdictionover <br />thesubjectpropertyatthetime,orseekingtoacquiresuchjurisdictionthroughannexation.A <br />Partyshallbedeemedtobe"seeking"annexationasofthedatewhenanannexationpetitionis <br />filed. NoPartyshallagreewithanylandownerorotherpersonorentityinterestedinanyparcel <br />withinthePlanAreatoallowanyuseordevelopmentwhichdoesnotcomplywiththePlan <br />withoutfirstobtainingaPlanAmendmentassetforthherein.ThePartieseachagreeto <br />undertakeallstepstoadoptprocedures,plans,policies,andordinancesorotherregulationsas <br />maybenecessarytoimplementandenforcetheprovisionsofthisPlan. AnyPartyadopting <br />suchprocedures,plans,policies,ordinancesorregulationsshallgiveeachoftheotherParties <br />3 <br /> <br />
