TotheextentthisPlanissilentastoa <br />particularlandusematter,existinglocallanduseregulationsasamendedfromtimetotimeof <br />theRegulatoryPartyhavingjurisdictionoverthepropertyshallcontrol. <br />3.COMPREHENSIVE DEVELOPMENT PLAN REGULATIONS <br />(a)INTRODUCTION. <br />These Comprehensive Development Plan Regulations are intended to provide specific land useand <br />development restrictions governing the Parties' actionsconcerning parcels located within the <br />subject Plan Area, theboundaries of which are set forth on the Mapattached as Exhibit A. <br />(b) DEFINITIONS: <br />i.DEVELOPMENT:Construction or establishment of structures,parking <br />areas, and/or surfaced vehicularroadways (except <br />expansion of existing roadsand except establishment <br />of new roads whereapproved by all Parties), or <br />establishment ofnew land uses. <br />ii.PLAN AREA:Lands included within the boundaries of the <br />designated Plan Area as set forth on the Mapattached <br />as Exhibit A,including right-of-way, setback areas, <br />and parcels subject to the plan's development <br />regulations. <br />iii.STRUCTURE:Any thing which is built or constructed, including but <br />not limited to an edifice orbuilding of any kind, or <br />any piece of workartificially built up or composed of <br />partsjoined together in some definite manner, but <br />excluding fences, retaining walls not over 6feet in <br />height, and buried utility lines. <br />(c)REGULATION OF USE AND DEVELOPMENT OF RURAL PRESERVATION <br />PARCELS. <br />(i)For parcels designated Rural Preservation on the Mapattached as Exhibit A, <br />labeled as Parcels 2,5, 6, 7, 8, 9, and 10,those existing uses of such parcels which conform to <br />BoulderCounty's regulations, or which are legally nonconforming,shall be permitted to continue, <br />either as legal or legalnonconforming uses. No density increase beyond the limitscurrently <br />permissible under the Boulder County Land Use Codeshall be approved for any such parcel, nor <br />shall any suchparcel be annexed to any municipal Party, unless the same isapproved through the <br />Plan amendment procedure set forth inSection 7of the Agreement, below.Development on parcels <br />for which "vested rights" for further development have been acquired through an estoppel against <br />Boulder County precluding the prohibition of suchdevelopment established by a final, non- <br />appealable courtjudgment in a proceeding of which theother Parties havebeen given timely notice <br />4 <br /> <br />
